Challenging the Evidence in DUI Cases
Police officers sometimes pull people over without good reason. Field sobriety tests are not properly given much of the time. Breath machines are often calibrated incorrectly and even when they are in good working order they can register higher than actual blood-alcohol content (BAC) levels for reasons that have nothing to do with drinking.
Despite what you may have been told by police or a prosecutor, DUIs are not "open and shut" cases. There are ways to defend them, to prevent the state from meeting its burden of proof.
At the law offices of Chrystel L. Gavlin, P.C., you will work with and be represented by a former Will County prosecutor who has extensive criminal trial experience. As your attorney, Ms. Gavlin will look for flaws in the evidence against you, work with professional investigators as needed, and start preparing your case for trial from the very beginning. And while a trial may not turn out to be necessary, the strategy itself allows us to be more aggressive in protecting your rights throughout.
Am I going to have to serve jail time? If this is your first DUI, you will probably not have to serve any time in jail. If you were convicted on a DUI charge prior to this arrest, no jail time may still be a real possibility. To talk with an experienced DUI defense lawyer about the charges you're facing and what we can do to help you. call or contact us today.
Will I Be Able to Keep My Driver's License?
Drunk driving convictions in Illinois carry mandatory minimum drivers' license suspensions. First convictions carry a minimum 1-year suspension. For second convictions, the minimum is three years. A third conviction will earn you a minimum of six years without your drivers' license.
As you can see, the penalties are harsh. We do our best to help clients avoid mandatory suspensions by taking an aggressive approach in their defense. That said, getting the charges dropped, the case dismissed or the prosecutor to reduce the charges down to something other than a DUI isn't always going to happen.
If your license is suspended, we may be able to obtain a judicial driving permit that will at least allow you to drive yourself to and from work.
